System of Ensuring Democratic Human Rights Legalized in DPRK Constitution

    The DPRK Constitution was adopted in September 1948 when the Republic was founded.

    The Constitution comprehensively legalized the democratic freedom and rights granted and provided to the people through individual regulations in accordance with their will and idea.

    Declaring equality of a citizen in all fields of social life, the Constitution regulated the rights to elect and to be elected in the field of politics, the freedom of speech, press, assembly, demonstration and association, the rights to forming and entering political party, public organization and other groups and the freedom of religious belief and religious rite.

    It also regulated the rights of the working people in the field of economic life to same payment for same work done, to material aid based on social insurance system and to management of small or medium trade and industry.

    In addition, it regulated such rights in the field of public life as the right to compulsory primary education and higher education at college and university at the state expense, the right to protected marriage and family, the right to personal inviolability, the right to appeal and petition, etc.

    The Constitution also regulated the right of asylum and equality of minority citizen proceeding from the principle of internationalism.

    The citizen’s rights and freedom regulated in the Constitution were the legalization of those the Korean people had and the substantial rights and freedom which are politically assured by state power, materially provided by achievements made through the democratic economic reform and guaranteed in detail by individual regulations.

    Thanks to the adoption of the Constitution, the issue of basic law, the most important in the system of ensuring human rights, was settled successfully, the legislative foundations capable of enacting human rights regulations were provided, and the human rights law could be developed on the basis of the well-regulated system.
